KIU Law Student Charged for recording High Court judge without consent

A 29-year-old law student from Kampala International University (KIU) has been charged with unlawfully accessing personal data belonging to a High Court judge.

Herbert Arinaitwe, a resident of Bulwa Zone in Rubaga Division, appeared before the Buganda Road Chief Magistrate’s Court on Tuesday. He denied the charge of unlawfully obtaining personal data, contrary to the Data Protection and Privacy Act and its accompanying regulations.

Prosecutors allege that on 10 October 2025, at the High Court in Kampala, Arinaitwe recorded a video of Justice Andrew Khauka without his consent.

State prosecutor Jane Francis Itae told Grade One Magistrate Alex Niyonzima that investigations were still underway. She objected to Arinaitwe’s release on bail, saying the documents he presented to prove his student status required verification.

“The accused has presented documents from the university, but we need to confirm with Kampala International University that he is indeed their student. If released, he may interfere with ongoing investigations,” Ms Itae said.

However, defence lawyer Norbert Rwabitti argued that his client was a bona fide student and had provided his university admission letter and student ID as proof. He added that Arinaitwe was due to sit for a Criminal Law examination on 15 October and had presented two reliable sureties.

“The documents submitted are originals, and there is no need for further verification. The accused has a constitutional right to bail,” Mr Rwabitti submitted.

In his ruling, Magistrate Niyonzima granted Arinaitwe a non-cash bail of Shs1 million, noting that the sureties were substantial. Each surety was bonded at Shs5 million, also not in cash.

The magistrate warned the sureties to ensure the accused appears in court or risk forfeiting the bond amount.

The case was adjourned to 25 November 2025 for hearing.
